Terms of Service

These Terms of Service ("Terms") govern your use of Aether ("the Bot", "the Service", "we", "us"). By adding Aether to a Discord server or using the web dashboard, you ("you", "the user", "the server administrator") agree to these Terms.


1. Eligibility

You must be at least 13 years old and comply with Discord's Terms of Service to use Aether. By using the Service, you confirm that you meet these requirements. Server administrators are responsible for ensuring their server members interact with Aether-powered features in compliance with applicable law and Discord's rules.


2. Acceptable Use

You agree not to use Aether to:

  • Violate Discord's Terms of Service or Community Guidelines
  • Harass, abuse, threaten, or harm any person
  • Distribute spam, malware, phishing links, or illegal content
  • Attempt to reverse-engineer, exploit, or disrupt the bot or its infrastructure
  • Circumvent subscription tier restrictions through any means
  • Use the FiveM integration to issue commands against players without appropriate server authority

We reserve the right to remove Aether from any server and terminate any account that violates these Terms, without notice or refund.


3. Subscriptions and Billing

3.1 Tiers

Aether offers three tiers: Free, Gold ($9.99/month), and Diamond ($18.99/month). Feature access is determined by your active tier at the time of use.

3.2 Billing

Subscriptions are processed and managed by Tebex. By subscribing, you also agree to Tebex's Terms of Service. We do not handle payment card data directly.

3.3 Upgrades and Downgrades

Upgrades take effect immediately. Downgrades take effect at the end of the current billing period. Your premium configuration is preserved for 30 days after a downgrade in case you resubscribe.

3.4 Cancellations

You may cancel your subscription at any time through Tebex. Access to premium features continues until the end of the paid billing period. No partial refunds are issued for unused time within a billing period.

3.5 Refunds

We offer refunds at our discretion within 7 days of initial purchase if you have not meaningfully used the premium features. Refund requests after 7 days or after significant use will not be granted. To request a refund, contact us in the support server.

3.6 Price Changes

We reserve the right to change subscription prices with at least 14 days' notice posted in the support server. Continued subscription after the notice period constitutes acceptance of the new price.


4. Custom Instances (Diamond)

By providing a bot token for a custom instance, you confirm that:

  • The bot application belongs to you or your organization
  • You have the right to authorize Aether to operate the bot on your behalf
  • You will not use the custom instance to violate these Terms or Discord's Terms of Service

Custom instance credentials are stored encrypted. You may revoke access at any time using /instance teardown. If your Diamond subscription lapses, the instance is shut down automatically and data is preserved for 30 days.


5. FiveM Integration

The FiveM integration enables staff to perform in-game actions (kick, ban, give items, etc.) via Discord commands. By enabling this integration, you accept that:

  • You are responsible for ensuring only authorized staff have access to FiveM commands
  • We are not responsible for any in-game actions taken using the integration
  • The guild token used to authenticate your FiveM server must be kept confidential

6. Data and Privacy

Use of Aether is subject to our Privacy Policy, which is incorporated into these Terms by reference.


7. Service Availability

We aim to keep Aether operational and maintained, but we do not guarantee uninterrupted availability. The Service may be taken offline for maintenance, updates, or circumstances outside our control. No refunds or credits are issued for downtime unless it is extended and caused solely by our failure.

We reserve the right to discontinue the Service with 30 days' notice. In the event of discontinuation, any active paid subscriptions will be refunded on a pro-rated basis.


8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant that:

  • The Service will be error-free or uninterrupted
  • The Service will meet your specific requirements
  • Any data stored by the Service will be preserved indefinitely

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Aether, including but not limited to:

  • Loss of server data or member data
  • Actions taken by the bot on behalf of configured commands
  • Downtime or service interruptions
  • Unauthorized access to your server or bot credentials

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid for the Service in the 3 months preceding the claim.


10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.


11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may stop using the Service at any time by removing the bot from your server and cancelling any active subscription. Termination does not entitle you to a refund except as described in Section 3.5.


12. Changes to These Terms

We may update these Terms as the Service evolves. We will post notice of material changes in the support server at least 7 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.


13. Governing Law

These Terms are governed by the laws of Texas, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Texas.
